Court grants interim bail to ex-AGF Malami in EFCC case
The High Court of the Federal Capital Territory, Abuja Judicial Division, has granted interim bail to former Attorney-General of the Federation, Abubakar Malami, SAN, in a case involving the Economic and Financial Crimes Commission.
The ruling was delivered on December 23, 2025, by Justice Bello Kawu while hearing Motion No: M/17220/2025.
In the court order, Justice Kawu said the interim bail would be on the same conditions earlier proposed by the EFCC.
These include Malami surrendering his international passport and providing two sureties who must execute bail bonds to the satisfaction of the court.
The judge noted that the conditions were sufficient to ensure the former minister’s availability whenever he is required by the court, pending further proceedings in the matter.
The sureties include the Director-General of the Nigerian Legal Aid Council and a serving member of the House of Representatives representing the Augie/Argungu Federal Constituency.
The court also reviewed and reactivated previously fulfilled bail conditions dated November 28, 2025, which required the provision of the two sureties and the surrender of the applicant’s international passport.
Justice Bello Kawu held that the application for bail was granted on grounds of exceptional hardship, pending the hearing and determination of the substantive motion on notice.
The matter has been adjourned to January 5, 2026, for the hearing of the motion on notice.
The order was issued under the seal of the High Court of Justice, Abuja, and signed by the Registrar, Hadiza Sambo Gwandu.
The impeachable source who confirmed the interim bail stated that Malami has accepted the conditions laid down by the EFCC and had adjourned the case to January, the 5th, 2025.
