Court throws out suit challenging Malami’s ADC governorship candidacy in Kebbi

The Federal High Court in Abuja has dismissed a legal challenge against the emergence of former Attorney-General of the Federation, Abubakar Malami, SAN, as the African Democratic Congress (ADC) governorship candidate in Kebbi State.

Delivering judgment on Tuesday, Justice M. G. Umar ruled that the plaintiff, Abdulrazak Isa Iko, failed to establish that he took part in the party’s primary election, a requirement that would have given him the legal right to contest the outcome.

The court held that Iko lacked the legal standing to challenge the process and consequently dismissed the suit in its entirety.

The ruling removes a key legal challenge and clears the way for the ADC candidate to focus on the political contest ahead.

Having resolved the threshold issue against the plaintiff, Justice Umar held that the action was devoid of merit and substance and accordingly dismissed the suit in its entirety.

With the dismissal, Malami’s candidacy remains intact, while the Court’s decision reinforces the long-established legal principle that only a person with the requisite legal standing can competently challenge the conduct of a party primary.
