US Congressman urges Nigeria to guarantee Nnamdi Kanu’s rights, fair trial

A member of the United States House of Representatives, John James, has called on the Nigerian Government to ensure that all legal proceedings involving Nnamdi Kanu comply with constitutional provisions and internationally recognised human rights standards.

The appeal followed the adoption of Resolution H.Res. 1321 by the U.S. House of Representatives on May 22, 2026. The resolution was reportedly sponsored by James and focuses on concerns surrounding Kanu’s detention, access to legal representation, medical care and due process.

Kanu, leader of the Indigenous People of Biafra (IPOB), has remained at the centre of a protracted legal battle that continues to attract both domestic and international attention.

According to the resolution, lawmakers raised concerns over the circumstances surrounding Kanu’s arrest in Kenya and his subsequent transfer to Nigeria in June 2021. The document noted that legal experts and international observers had questioned whether the transfer complied with applicable legal procedures and international obligations.

The resolution also referenced the July 2022 opinion of the United Nations Working Group on Arbitrary Detention, which concluded that Kanu’s detention violated international human rights standards and recommended remedial action.

It urged Nigerian authorities to carefully consider the findings of the UN body and take steps consistent with its recommendations.

Among the issues highlighted were Kanu’s access to legal counsel, detention conditions, medical treatment and adherence to due process throughout ongoing judicial proceedings.

The resolution called on the Nigerian Government to ensure that Kanu is granted uninterrupted access to legal representation, necessary healthcare and humane detention conditions in line with international standards.

It further urged the U.S. Secretary of State to engage Nigerian authorities on concerns relating to due process, detention conditions and the protection of fundamental rights.

The lawmakers also cited concerns previously raised by human rights organisations regarding fair trial guarantees and conditions of detention, stressing that respect for the rule of law, freedom of expression and humane treatment of detainees remain core principles under international law.

The development is expected to draw renewed international attention to Kanu’s case and increase scrutiny of Nigeria’s handling of one of its most closely watched legal and political matters.
