Police withdraws fraud charges against Andy Uba as ex-Senator refunds N400m
The Inspector-General of Police (IGP) has withdrawn the N400 million fraud case filed against Andy Uba, a former senator representing Anambra South, following an amicable settlement between the parties involved.
Uba and his co-defendant, Benjamin Etu, were accused of obtaining N400 million from one George Uboh in 2022 under false pretence.
The duo, alongside one Hajiya Fatima (who is currently at large), allegedly claimed they could facilitate the appointment of a managing director for the Niger Delta Development Commission (NDDC) in exchange for the money.
The charge stated that their actions constituted “an offence contrary to Section 8 and punishable under Section 1 (3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006.”
The Attorney-General of the Federation (AGF) had granted the IGP permission on July 7 to prosecute the case.
However, several attempts to arraign the defendants failed, prompting the court on September 24 to threaten an arrest warrant against Uba if he did not appear.
At the resumed hearing on Thursday, police counsel Aminu Abdullahi informed the court that a notice of discontinuance had been filed and served earlier that morning, following a resolution between the parties.
“We filed and served a notice of discontinuance this morning,” Abdullahi said, adding that Uba and his co-defendant had refunded the N400 million to the complainant.
Counsel to the defendants, C.F. Odiniru, did not oppose the prosecution’s decision.
In his ruling, Justice Mohammed Umar accepted the notice of discontinuance, struck out the charges, and discharged the defendants.
